Terms and conditions for all business and trade with DMTonline ApS
1. Validity:
• NL 92 is applicable between the involved parties, unless these conditions or other written agreement has been derogated from said condition. Copy of NL92 can be obtained on request.
• These conditions apply to any future trade between the involved parties, starting from the first purchase made.
• DMTonline ApS reserves the right to freely and ongoing modifying of the specified conditions.
• The current terms and conditions can be viewed on www.dmtonline.dk.
2. Offer / Quotes:
• All quotes and offers are made with reservation towards in-between sales and void if no acceptance is received within 30 days.
3. Price:
• All prices are excl. VAT, excl. shipping / postage, unless otherwise specified, and subject to changes in exchange rates, custom duties, taxes, fees etc., related to the delivery. • Working hour rates are exclusive VAT, transportation and materials.
4. Payment Terms:
• Cash or advance payment (customers without an existing account agreement)
• Net eight days or by agreement (customers with an existing account agreement)
• Payment can be made by valid credit cards or bank transfer to DMTonline ApS.
4.1. Retention:
• The seller retains property of the delivered goods until full payment for the entire delivery and financial balance between the parties have occurred.
5. Reservations:
• Reservation are made for misprints in the catalog, on the website, price changes, obsolete and discontinued products, delivery failure by third parties, as well as force majeure.
6. Delivery:
• DMTonline ApS strive to deliver stocked products the next working day after received order.
• Pls. note the order must be submitted before 3 p.m. on weekdays, and Friday before 2 p.m.
• Other products and special sourced products are normally delivered within 5-7 working days.
• Delays do not entitle the buyer to cancel the order unless written accept by DMTonline ApS.
• DMTonline ApS is exempted from any fines, claims and compensation for delayed delivery or compensation for any occurred losses related to delivery.
7. Returning of goods:
• DMTonline ApS only accept items to be returned after prior agreement.
• Returning of stocked items is accepted up to 14 days from date of invoice.
• Returned items must be without any damage and be returned in intact original package including original transport material.
• In case the item is incomplete when received, DMTonline ApS reserves the right to deduct the equal amount and cost of bringing the goods back to original condition by delivery.
• Costs and risk related to returning of the goods to DMTonline ApS, is the responsibility of the customer and paid by the customer
• Discontinued and obsolete items, and items made to order, including special sourced products are not accepted as returnable.
8. Packaging material:
Packaging material and packaging method is selected and done by DMTonline ApS in an appropriate way. Pls. observe that packaging material is not returnable.
9. Shipping / transportation:
For all items sold DMTonline APS request transportation to be paid for by the costumer and unless otherwise agreed, the goods is insured by DMTonline ApS according to the invoice value till the agreed delivery address.
The shipping cost will be separately specified. This insurance in the amount of the invoice value is only valid if the claim occurs the same day as the product is received. In case claims do not happen the same day, the shipment is regarded as delivered ex-works DMTonline ApS stock in Saeby Denmark. Minimum / shipping fee is DKK. 44,00 excl.
VAT. Although goods sent with the minimum shipping fee is not insured and is sold ex-works DMTonline ApS stock, and as such the shipping can’t be traced, neither can any claims for loss of shipment be made against the carrier or DMTonline ApS.
10. Documentation:
No documentation is to be disclosed to third parties. Dimensions and weight are not binding.
11. Change in product range:
Specifications of DMTonline ApS' product range might change without any further notice.
12. Complaints:
In case of a defect in a product, the buyer must immediately when found and no later than 8 days after receipt of the goods, notify DMTonline ApS, incl. a written statement and proof of the defect. DMTonline ApS is entitled to reject all claims which are not made according to above.
13. Product liability:
DMTonline ApS product liability is according to Danish law ordinary rules, and damage liability cannot exceed DKK 30,000.00. DMTonline ApS cannot be held responsible for any operational losses, loss of earnings and other indirect losses.
14. Limitation of Liability
Any claim directed to DMTonline ApS is limited to the direct loss, and as such claims related to time loss, including loss of profit and other indirect costs of the customer. Furthermore, the loss cannot exceed the value of the invoice, which includes the object that is the basis for the raised claim.
15. Warranty:
Standard guarantee on delivered goods against manufacturing and material defects is 6-months, including a 2 year warranty from date of invoice. The original invoice must be presented on all guarantee and warranty issues. DMTonline ApS cannot be held liable towards any guarantee and warranty claims if the attached warranty label "WARRANTY VOID IF REMOVED" is broken or damaged. The product must be returned in its complete original packaging and transport material to maintain the standard product guarantee and warranty. DMTonline ApS is entitled to reject the alleged guarantee and warranty if the item is damaged by return shipment due to wrong packaging of the goods. The specific In & Output section in amplifiers and radios are not covered by the guarantee. The guarantee and warranty does not cover defects caused by misuse, lack of maintenance or repairs that are not made by seller. The guarantee and warranty does not cover in case of fire, burglary / theft, water and liquid damage, etc. including failure due to software setup that is not made by the seller. The guarantee and warranty does not cover in case of disassembly, reassembly, reinstallation of software and other adaptations of the item. The guarantee and warranty of the equipment is only valid if the equipment is installed and used in accordance with the designated specifications given by the seller. The guarantee and warranty covers only the specified goods / equipment supplied. Compensation for consequential loss or damage of goods delivered is not covered. In case supplied products must be replaced or repaired, the buyer on he´s cost provides the item / equipment to the sellers business address. Replaced or repaired products is returned to the buyer on sellers cost.
NOTE: Before delivery for repair or replacement, buyer should ALWAYS make complete BACKUP of data and software. The repair and / or restoration are performed without liability for loss of data.
16. Exceptions:
If specific conditions are stated in the DMTonline ApS quote and offer, these are valid even they deviate from the above.
17. Disputes:
Disputes will be settled under Danish law by the Court in Hjoerring.
18. Information on Customer:
• Received customer information is only used for processing of your order. Received customer information is not given to third parties or used for marketing without prior agreement.
• The customer agrees and confirms that the received and given e-mail address can be used for all communication in relation to business.
